The Library policy for reserve reading services, paper or electronic, is based upon the fair use provisions of the United States Copyright Act of 1976.  All library materials are acquired with the understanding that there will be multiple uses of a limited number of copies.  Libraries frequently pay a premium institutional subscription price for the privilege of supporting multiple academic users.  The purpose of the Iowa State University Library Reserve System will be to facilitate the making of multiple copies for classroom use by students.  The following policies are meant to aid all parties in conforming to fair use provisions of the copyright law.

1. All use of materials placed on reserve will be at the initiative of instructors solely for the non-commercial, educational usage of students.  The Library will not charge students for access to Reserve materials.
     
2. Reserve materials will be limited to a small part of the "required" materials for the course.
      
3. Reserve items will be from materials an instructor or the Library already possesses legally.  (i.e., by purchase, license, fair use, interlibrary loan, etc.) We reserve the right to refuse to copy or make available duplicated material in violation of U.S. copyright law.
     
4. Copying will not be used to create, replace or substitute for anthologies, compilations, or collective works.  Instructors wishing to create readings/course packs should work with the University Bookstore.  The Bookstore will seek the necessary permissions.  Legal course packs will be allowed on reserve.
     
5. Reserve will accept no copying of or from works intended to be "consumable."  Ex. Workbooks, exercises, standardized tests and test booklets, etc.
      
6. The following material will be placed in the ISU Library Reserve without obtaining copyright permission:
   - Exams
   - Lecture notes (The Library considers this the property and responsibility of the instructor.)
   - U.S. Government publications
   - Material within the public domain
   - One time use of one article from a journal issue
   - One time use of one chapter from a book
   - One time use of one short story, short essay or short poem
   - One time use of one chart, graph, diagram, drawing, cartoon or picture from a book, periodical or newspaper
      
7. Materials must be submitted with full citation information.  Citations are needed in obtaining copyright permission and processing cannot begin until all information is provided.  Lack of a full citation may delay processing of reserve requests.
     
8. Where there is not a showing of permission of the copyright holder, copyright permission will be sought when:
   - material will be used repeatedly by the same instructor for the same or similar course
   - multiple articles from one journal are needed for a particular course
   - multiple chapters from one book are needed for a particular course
   - multiple charts, graphs, diagrams, drawings, cartoons or pictures from a book or periodical or newspaper
   - an out of print book is needed
     
9. Where there is not a showing of permission of the copyright holder, copyrighted material will be used in Reserve for one semester only (one time, spontaneous use).   Permission from the copyright holder and/or payment of royalties will be required for subsequent use of material by that instructor and course.  Instructors submitting non-published student or faculty authored papers and projects must include written copyright permission from each student author. 10. Parks Library will seek copyright permission as needed, pay any reasonable publisher's fees, and post appropriate copyright notices.  The library reserves the right to limit the number of items on reserve for a given course based on copyright constraints, royalty costs, etc.
      
11. Reserve will post copyrighted materials while waiting for permission.  Should permission be denied, the instructor will be notified and material removed from Reserve 7 days after notification.  Should the copyright holder not respond, the Library will resubmit the request with each use for 2 years.  Non-response will be documented and use of material will continue.
       
12. Reserve material will be posted with the following information: proper citation, any copyright notice from the original and notice that further copying, publication or display may be a violation of copyright law.
      
13. Access will be provided only to the ISU community through IP address or ISU identification number and Library pin number.  Materials will be searchable by instructor or course name/number. 
      
14. Material made available in electronic format will generally not be made available in duplicated traditional print format.
      
15. Materials will be removed from Reserve at the close of the semester of use. If by the end of the fourth week of the next semester, Reserve has not received notice of their continued use, materials will be sent back to instructors and/or returned to the stacks.
      
16. Instructors should plan on at least 3-5 days of processing time from date of receipt before items will be available.   (During the first 3 weeks of every semester, Reserve is inundated with material.   Processing may take up to 2 weeks at this time.)  Items needing to be scanned may also require up to 2 weeks.
